  6. Evaluation License

  8. 3D ImageCube is Shareware, or Try-Before-You-Buy software, not free software. That means you can use it free of charge for a 15 trial use evaluation period. After that, you must either register your copy of the product by paying a small license fee, or stop using it. This registration fee will license one copy of 3D ImageCube for use on a single computer. Site licenses are also available.

  10. 3D ImageCube may not be distributed as part of, or for use with, any commercial product without express written permission from TriVista Technologies, Inc.  You are specifically prohibited from charging or requesting donations for any copies, however made, without written permission from TriVista Technologies, Inc.

  12. 3D ImageCube is protected by federal copyright law and international treaty.

  14. Registered Version

  16. When 3D ImageCube has been registered, it is no longer considered Shareware, and may not be freely distributed.

  18. One registered copy of 3D ImageCube may either be used by a single person who uses the software personally on one computer, or installed on a single workstation used non-simultaneously by multiple people.

You may access the registered version of 3D ImageCube through a network, provided that you have obtained individual licenses for the software covering all workstations that will access the software through the network. For instance, if 8 different workstations will access 3D ImageCube on the network, each workstation must have its own 3D ImageCube license, regardless of whether they use 3D ImageCube at different times or concurrently.

  22. Except to the extent expressly licensed herein, all rights are reserved to Trivista Technologies,  Inc. and its suppliers. You may not reverse engineer, decompile, or disassemble 3D ImageCube.

  24. Limited Warranty and Limitation of remedies:

NO WARRANTIES. To the maximum extent permitted by applicable law, TriVista Technologies, Inc. expressly disclaims any warranty for 3D ImageCube. 3D ImageCube and  any related documentation is provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied  warranties of merchantability or fitness for a particular purpose. The entire risk arising out of use or performance of 3D ImageCube remains with you. TriVista Technologies, Inc.'s entire liability and your exclusive remedy, at TriVista Technologies, Inc.'s option, shall be the cost of 3D ImageCube or its replacement with another copy of  3D ImageCube.

To the maximum extent permitted by  applicable law, in no event shall TriVista Technologies, Inc. or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profit, business interruption, loss of business information, or any other pecuniary loss) arising out of the use or inability to use this TriVista Technologies,Inc. product, even if TriVista Technologies, Inc. has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
